Terms of Service
Effective Date: November 3, 2026
Welcome to myfortisprivatewealth.com (the "Site"). The Site is operated by Fortis Portfolio Solutions LLC, doing business as Fortis Private Wealth ("Fortis Private Wealth," "we," "us," or "our"). These Terms of Service (the "Terms") are a binding agreement between you and Fortis Private Wealth that governs your access to and use of the Site. Please read them carefully.
Accepting and Changing These Terms
You accept these Terms by accessing or using the Site in any way. That use also confirms your consent to how we handle your information, as described in our Privacy Policy. If any part of these Terms is unacceptable to you, your only option is to stop using the Site.
We may update these Terms from time to time. Any updated version takes effect once we post it here and update the "Effective Date" shown above, and your continued use of the Site afterward means you accept the revised Terms. We are not obligated to notify you of changes individually, so please check this page periodically.
Some features or services offered through the Site may come with their own supplemental terms ("Additional Terms"), which you must also follow. If Additional Terms conflict with these Terms for a given feature or service, the Additional Terms control for that item unless they say otherwise.
Who May Use the Site
You may use the Site only if you are at least 18 years old, have the legal capacity to enter a binding contract with us, and are not prohibited by applicable law or regulation from receiving what the Site offers. In using the Site, you agree to comply with every law and regulation that applies to you.
Educational Content; No Individualized Advice
The Site and its contents are provided for general informational and educational purposes only. Nothing on the Site is individualized investment, tax, legal, or financial advice, and nothing on it is a recommendation that any person buy, hold, or sell any security or pursue any strategy. Market commentary, articles, and white papers reflect the author's views as of the date written and may change without notice.
No advisory relationship is created by your use of the Site, by reading its content, by subscribing to our communications, or by requesting or attending an introductory conversation. Fortis Private Wealth provides investment advice only to clients who have signed a written investment advisory agreement with Fortis Portfolio Solutions LLC. Once that agreement is in place, we act as a fiduciary to that client as described in our Form ADV and the agreement itself. Until then, no fiduciary or advisory duty exists, and you should not act on anything on the Site without consulting a qualified professional about your own situation.
Our Content and Your License to Use It
The Site and its contents, including its design, layout, and "look and feel," together with all text, articles, data, files, images, graphics, photographs, audio, video, software, trademarks, logos, trade names, and every other form of intellectual property it contains (collectively, the "Content"), belong to Fortis Private Wealth, our licensors, or other third parties. All of it is protected to the fullest extent allowed by U.S. and international copyright, trademark, trade dress, unfair competition, and related laws. Every right we do not expressly grant you here is reserved, and nothing in these Terms grants any right or license by implication, estoppel, or otherwise.
So long as you comply with these Terms and any Additional Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to view, download, display, and use the Site for your own personal, non-commercial purposes. This license transfers no ownership of the Site or the Content, and we may suspend or revoke it at any time, for any reason, without notice or liability. Using the Site or Content outside this license may violate copyright, trademark, privacy, or other laws.
Acceptable Use
When you use the Site or Content, you agree that you will not:
- do anything unlawful, harmful, offensive, threatening, harassing, abusive, or otherwise objectionable;
- scrape, harvest, or otherwise collect information from the Site or Content;
- reverse engineer, decompile, or modify the Site or Content;
- disrupt or interfere with the Site's proper operation or its security features;
- infringe any third party's intellectual property or other rights;
- use the Site or Content in a way that falsely suggests an association with Fortis Private Wealth or that exceeds the license granted above; or
- otherwise breach these Terms or any Additional Terms.
You agree to tell us promptly if you learn of any actual or suspected unauthorized use of the Site or Content.
Availability, Suspension, and Termination
We may change, discontinue, interrupt, suspend, or terminate all or part of the Site, including any Content or feature, at any time, for any user or every user, at our sole discretion and without prior notice or liability. Access may also be disrupted by circumstances inside or outside our control, including routine maintenance. Everything required for you to reach and use the Site, including hardware, software, and connectivity, is your responsibility. If your access ends, every right granted to you under these Terms terminates at once and you must stop using the Site.
Electronic Communications
We may contact you electronically about the Site, including by email, and we may keep records of those communications. You agree that any notice, disclosure, agreement, or other communication we send electronically satisfies any legal requirement that it be in writing, and that each time you agree or consent through the Site electronically you are providing an electronic signature.
You can opt out of our marketing emails using the instructions in those messages. We may still send you non-marketing messages, such as administrative or service notices, and opting out of marketing does not stop those.
Publication Dates
Material on the Site speaks as of the date it states or, if it states none, as of the date it was first posted. Neither we nor anyone else has any obligation to update it.
Disputes and Arbitration
Should a dispute arise between you and Fortis Private Wealth relating to the Site, we both agree, to the extent the law allows, to resolve any claim or controversy through binding arbitration, or by another method we agree to in writing. We encourage you to email us first at mer@fortisportfolio.com so we can try to resolve the matter directly. The provisions of this section that call for arbitration are intended as a "written agreement to arbitrate" under the Federal Arbitration Act, and they may be amended only by mutual agreement.
Binding arbitration. Any controversy, allegation, or claim connected in any way to your use of the Site (a "Dispute") will be submitted to confidential arbitration in Illinois, except that where you have infringed or threatened to infringe our intellectual property rights, we may instead seek injunctive or other appropriate relief in any state or federal court. You consent to the personal jurisdiction and venue of the state and federal courts of Illinois. Arbitration will follow the Commercial Arbitration Rules of the American Arbitration Association then in effect; the arbitrator decides questions of arbitrability; and the arbitrator's award is final, binding, and enforceable as a judgment in any court of competent jurisdiction. Illinois law governs any Dispute without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration provisions themselves. If any claim proceeds in court rather than arbitration, you and Fortis Private Wealth each waive the right to a jury trial.
What arbitration does not cover. Claims either of us brings in small claims court, and claims we bring to protect our own or our licensors' intellectual property, are not subject to these arbitration provisions. Nothing in this section limits any rights you may have under federal or state securities laws that cannot be waived.
Deadline to bring claims. Regardless of any law to the contrary, any claim or cause of action arising out of or relating to the Site must be brought within one year after it arises, or it is permanently barred.
No class actions. Disputes will be arbitrated only individually and will not be joined or consolidated with any other person's claim. You may bring claims against Fortis Private Wealth only in your individual capacity, never as a plaintiff or member in any class or representative action.
Disclaimer of Warranties
The Site, the Content, and all related links and communications are provided "as is," and you use them at your own risk, to the fullest extent the law permits. Fortis Private Wealth makes no warranties, representations, or conditions of any kind, express or implied, about the Site, and expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any implied assurances about results, accuracy, completeness, accessibility, security, or freedom from viruses. Where the law does not allow some or all of these disclaimers, they apply to the fullest extent it does allow.
Limitation of Liability
Your sole and exclusive remedy for any dissatisfaction with the Site is to stop using it. To the fullest extent permitted by law, neither Fortis Private Wealth nor our vendors will be liable for any direct, indirect, special, incidental, consequential, or exemplary damages arising from or relating to your use of the Site or receipt of any communication, including damages for lost profits, lost data, lost goodwill, work stoppage, or computer failure, even if we were advised such damages were possible, and regardless of the legal theory on which the claim rests. Because some jurisdictions do not permit the exclusion or limitation of consequential or incidental damages, in those jurisdictions our liability is limited to the greatest extent the law allows. This section applies to the Site and its Content; it does not limit any duties we owe to a client under a signed advisory agreement or under applicable securities laws.
Indemnification
You agree to defend, indemnify, and hold Fortis Private Wealth harmless from every claim, liability, damage, loss, cost, and expense, including reasonable attorneys' fees, that arises out of or relates to your breach of these Terms or any Additional Terms, your use of the Site, your violation of any law or regulation, your infringement of any third party's rights, or any misrepresentation you make. We may, at your expense, take over the exclusive defense of any matter you would otherwise be required to indemnify, and you agree to cooperate with our defense and not to settle any claim without our prior written consent.
Third-Party Content, Links, and Business Transfers
For your convenience, the Site may include content, links, and other information supplied by third parties we neither control nor answer for, including scheduling and email tools. We are not responsible for the accuracy, legality, or any other aspect of third-party sites or services, and including a link does not mean we endorse the site or have any association with its operators.
We may transfer information gathered through the Site if we sell or transfer all or part of our business or assets, for example in a reorganization, merger, or similar transaction, including negotiations toward one, subject to our Privacy Policy.
General Terms
Severability and headings. If any provision of these Terms is found invalid or unenforceable, it will be severed and the rest will remain in full effect. Section headings are for convenience only.
Assignment. We may assign our rights and obligations under these Terms to anyone at any time without notice. You may not assign these Terms without our prior written consent.
Entire agreement and no waiver. These Terms and any Additional Terms are the complete agreement between us about the Site and supersede any earlier agreement or discussion about it. They do not modify any investment advisory agreement between a client and Fortis Portfolio Solutions LLC. No delay or failure by us to exercise a right waives it, and no waiver or modification is effective unless in writing and signed by us.
Investigations and law enforcement. We may investigate any suspected violation of these Terms, and we may disclose information as needed to comply with any law, regulation, legal process, or government request.
International use. We operate the Site from the United States and make no representation that it is appropriate or available elsewhere. If you use it from another location, you do so on your own initiative and are responsible for complying with local law.
